Clearing Your Record of a DUI Conviction

Expungement of DUI charges and convictions is possible. After a DUI conviction, you can request a new trial. During the course of your treial, there may have been procedural problems or errors, and based on those facts, your DUI lawyer may ask the court for another trial. If the judge agrees to the new trial, you can defend yourself again before a new jury. If during this trial, you’re found innocent you can have your record expunged as though had no DUI conviction from your first trial. Occasionally, when the court grants a new trial, the prosecuting attorney may make a better guilty plea offer or even reduce the DUI charges. They may even decide not to pursue the case further due to the time and cost involved.  It can pay to aggressively fight DUI charges.

The Massachusetts courts specificy the possibility of DUI / DWI expungement relief, whereafter the individual is relieved of all legal penalites or disabilities stemming from the former DUI / DWI conviction. This is simply the deletion of a record from government files and may include the obligation to report your DUI conviction on job applications.
