Ignition Interlock System for DUI

Due to the adoption and enhancement of Melanie’s law, use of ignition interlock devices has been adopted when applying to obtain a hardship license, for those with multiple drunk driving convictions.  The ignition interlock device is a new use of technology to prevent repeat (OUI, DUI, DWI) cases. If you appeal DUI conviction, you may require an interlock device if the appeal is accepted and you should have acquired one before your DUI appeal.

The Ignition Interlock Device

The ignition interlock device is a portable handheld breath-alcohol (BAC) monitoring system that is electronically installed by a professional and controls access to your vehicle’s ignition system. It is wired to the vehicle’s ignition system in the dash of the vehicle. It must be installed in every vehicle the user intends to operate. In order to start any car you lease, own or operate, the operator must breathe into the breath testing machine and pass its test in order to start the vehicle.  The ignition interlock also requires the vehicle operator to perform a rolling re-test while the vehicle is running.

The interlock device must be installed in the operator’s car before he or she can apply for a hardship license. The system also contains a data recorder, which stores information about any attempts to start the vehicle. That data includes date, time, subject’s blood alchol level, any lock-out events, and any attempts to bypass the interlock unit.

The Massachusetts Driver Registry the registry also requires from the driver, a signed affidavit certifying understanding of the rules for the hardship drivers license.
